Durable Power of Attorney

A Durable Power of Attorney is a written document where a person appoints an agent, known as an attorney in fact, to act for them should they be unable to act. No matter what our age or circumstances, all of us need a well drafted Durable Power of Attorney.  For instance, we could be tragically involved in an accident or have a sudden illness notwithstanding our age.  The concept of durability means the power of the agent continues through the duration of the incapacity of the principle. It is important that the document be extraordinarily specific in its wording as to the grant of powers.  Generic and broad grants of power are many times rejected as not particular or specific.  Obtaining a Power of Attorney can be expeditious and inexpensive. However, such a document can save thousands of dollars and months of delay should a need arise.
